Protecting your privacy is really important to us. With that in mind, this Privacy Notice describes how Welbean, Inc. (collectively “Welbean,” “we,” “us”) collects, processes, uses, discloses, and secures information that we receive through the Welbean Properties. This Privacy Notice does not apply to any third-party websites, services or applications, even if they are accessible through the Welbean Properties. Also, please note that, unless we define a term in this Privacy Notice, all capitalized terms used in this Privacy Notice have the same meanings as in our Terms of Service. So, please make sure that you have read and understand our Terms of Service.

There are many different ways you can use the Welbean Properties. As you use the Welbean Properties, we want you to be clear about how we are using information and the ways in which you can protect your privacy.
Our primary goals in collecting information are to provide and improve the Welbean Properties, to administer your use of the Welbean Properties (including your Account, if you are an Account holder), and to enable you to enjoy and easily navigate our Welbean Properties.
If you create an Account, we’ll collect certain information that can be used to identify you (“ PII ”), such as your name, postal address, email address and mobile or other telephone number. We may also collect other information, such as date of birth; gender; patient medical data (such as medications and ailments); payment information (such as payment card number, expiration date, delivery address, and billing address); information collected by the Welbean Devices, including health information (such as heart and lung recordings, temperature data, heart rate, respiratory rate, the location on the body where the recording was taken (e.g. lower right back, chest), mobile device accelerometer data, local time, time zone and geographic location of data acquisition); contact information of individuals such as medical professionals, human patients and/or their parents or guardians or dependents, and other visitors; and information in customer support inquiries.
When you visit our Welbean Properties or open our emails, we may collect certain information by automated means, such as cookies, web beacons and web server logs. The information we collect in this manner includes IP address, browser characteristics, device characteristics, operating system version, language preferences, referring URLs, information on actions taken on our Welbean Properties, and dates and times of website visits. The information does not identify you. If you continue to use our Welbean Properties, we will assume that you permit this collection.
A “ Cookie ” is a file that websites send to a visitor’s computer or other Internet-connected device to uniquely identify the visitor’s browser or to store information or settings in the browser. We may use both session Cookies and persistent Cookies to identify that you’ve logged in to the Welbean Properties and to tell us how and when you interact with our Welbean Properties. We may also use Cookies to monitor aggregate usage and web traffic routing on our Welbean Properties and to customize and improve our Welbean Properties. Unlike persistent Cookies, session Cookies are deleted when you log off from the Welbean Properties and close your browser. Although most browsers automatically accept Cookies, you can change your browser options to stop automatically accepting Cookies or to prompt you before accepting Cookies. Please note, however, that if you don’t accept Cookies, you may not be able to access all portions or features of the Welbean Properties. Some third-party services providers that we engage (including third-party advertisers) may also place their own Cookies on your hard drive. Note that this Privacy Notice covers only our use of Cookies and does not include use of Cookies by such third parties.
A “Web Beacon” (also known as an Internet tag, pixel tag or clear GIF) links web pages to web servers and their cookies and may be used to transmit information collected through cookies back to a web server. Through these automated collection methods, we obtain ‘clickstream data,’ which is a log of the links and other content on which a visitor clicks while browsing a website and identifies the prior website used to access the Welbean Properties. As the visitor clicks through the Welbean Properties, a record of the action may be collected and stored. We may link certain data elements we have collected through automated means with other information we have obtained about you to let us know, for example, whether you have opened an email we sent to you.
“ Log Data ” refers to certain information about how a person, including both Account holders and non-Account holders (either, a “ User ”), uses our Welbean Properties recorded automatically by our servers. Log Data may include information such as a User’s Internet Protocol (IP) address, browser type, operating system, the web page that a User was visiting before accessing our Welbean Properties, the pages or features of our Welbean Properties to which a User browsed and the time spent on those pages or features, search terms, the links on our Welbean Properties that a User clicked on and other statistics.
We use cookies, web beacons, web server logs and other automated means for purposes such as (i) customizing users’ visits to our Welbean Properties, (ii) delivering content tailored to users’ interests and the manner in which users browse our Welbean Properties, and (iii) managing our Welbean Properties and other aspects of our business.
We collect certain information that your mobile device sends when you use our Welbean Properties , like a device identifier, user settings and the operating system of your device, as well as information about your use of our Welbean Properties .
When you use our Application, we may collect and store information about your location by converting your IP address into a rough geo-location or by accessing your mobile device’s GPS coordinates or coarse location if you enable location services on your device. We may use location information to improve and personalize our Welbean Properties for you. If you do not want us to collect location information, you may disable that feature on your mobile device.

We may retain your PII even if you cease using the Welbean Properties until such time as you notify us, as indicated in the ‘How to Contact Us’ section of this Privacy Notice, of your intention to cease using the Welbean Properties indefinitely.
We do not sell or otherwise disclose PII we collect about you, except as described in this Privacy Notice. We do not rent, sell, or share your PII with other people or nonaffiliated companies for their direct marketing purposes, unless we have your permission.
We may share your information with Third-Party Services, Healthcare Providers, other Account holders or other third parties (“ Permitted Parties ”) if you permit them to access your data through the Welbean Properties or you choose to send them your data or web links to your data via email, SMS or any other means. If you wish to retract sharing of your data, please submit a request via the ‘How to Contact Us’ section of this Privacy Notice. Please note, however, that Welbean cannot retract any information that has already been shared with a Permitted Party.
We also may share PII with vendors and service providers who perform services for us in connection with the provision of the Welbean Properties based on our instructions. Examples of these vendors and service providers include entities that process credit card payments, fulfill orders and provide web hosting services. We do not authorize these vendors or service providers to use or disclose the PII except as necessary to perform services on our behalf or comply with legal requirements.
We may share aggregated information and non-identifying information with third parties for industry research and analysis, demographic profiling and other similar purposes. We may use third-party web analytics services on our Welbean Properties, such as those of Google Analytics. The analytics providers that administer these services use technologies such as cookies, web server logs and web beacons to collect usage information matched to an IP address to help us analyze how visitors use the Welbean Properties and improve the overall experience of the Welbean Properties. The analytics providers may also collect information about your use of other websites over time, if those websites also use the same analytics providers. We cooperate with government and law enforcement officials or private parties to enforce and comply with the law. In addition, we may access, preserve, and disclose any information about you (i) if we are required to do so by law or legal process, (ii) to law enforcement authorities or other government officials, (iii) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss, or in connection with an investigation of suspected or actual fraudulent or illegal activity, and (iv) to protect your, our, or others’ rights, property or safety.
Information that we collect from our users, including PII, is considered to be a business asset. In the event we sell or transfer all or a portion of our business or assets (including in the event of a reorganization, dissolution or liquidation), some or all of our assets, including your PII, may be disclosed or transferred to a third party acquirer in connection with the transaction. Following such a sale or transfer, you may contact the entity to which we transferred your PII with any inquiries concerning the processing of that PII.
We offer you certain choices in connection with the PII we collect from you, such as how we use the PII and how we communicate with you, and we’ll respect the choices you make. Please note that if you decide not to provide us with the PII that we request, you may not be able to access all of the features of the Welbean Properties.
To update your email preferences, ask us to remove your PII from our mailing lists or submit a request, please contact us as indicated in the ‘How to Contact Us’ section of this Privacy Notice.
Users with online accounts may be able to update or delete certain PII using the Welbean Properties. You may request access to the PII we maintain about you or request that we correct, amend, delete or block the information by contacting us as indicated below by submitting a request via the ‘How to Contact Us’ section of this Privacy Notice. You may withdraw any consent you previously provided to us or object at any time on legitimate grounds to the processing of your PII, and we will apply your preferences going forward. To exercise any of these rights, please submit a request via the ‘How to Contact Us’ section of this Privacy Notice.
We maintain administrative, technical and physical safeguards designed to protect the PII that we collect from or about you against accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure or use. Please be aware, however, that no method of transmitting information over the Internet or storing information is completely secure. Accordingly, we cannot guarantee the absolute security of any information.
The Welbean Properties may provide links to other websites and applications for your convenience and information. These websites and applications may operate independently from us. Linked sites and applications may have their own privacy notices or policies, which we strongly suggest you review. To the extent any linked websites or applications are not owned or controlled by us, we are not responsible for the sites’ or applications’ content, any use of the sites or applications, or the privacy practices of the sites or applications.
Any information that is collected via the Welbean Properties is covered by the Privacy Notice in effect at the time such information is collected. This Privacy Notice may be updated periodically and without prior notice to you to reflect changes to our information practices. We will post a prominent notice on our Welbean Properties to notify you of any significant changes to our Privacy Notice and indicate at the top of the notice when it was most recently updated. Where required by law, we will seek your explicit consent to specific changes. You agree that Welbean will reserve the right to occasionally notify you via email of any important changes to this Privacy Notice.
Our Website does not have the capability to respond to “Do Not Track” signals received from various web browsers.
Your PII may be transferred to, and maintained on, computers located outside of your state, province, country or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. If you’re located outside the United States and choose to provide your PII to us, we may transfer your PII to the United States and process it there.
Our Welbean Properties are not directed to children under 13 and we do not knowingly collect PII from children under 13. If we learn that we have collected PII of a child under 13 we will take steps to delete such information from our files as soon as possible.
